PRIVACY AND COOKIE POLICY

1. General

1.1 This privacy and cookie policy ("Privacy and Cookie Policy") (together with our terms of use at https://bluemarket.co.za/legal/TermsOfUse.txt and any other documents referred to therein ("Terms of Use") explains how personal data are collected from you and used by BlueMarket ("BlueMarket" or "we", "us", "our") its subsidiaries, affiliated companies and other third parties. This Privacy and Cookie Policy applies to (i) the BlueMarket website at https://bluemarket.co.za (the "Site"), (ii) the BlueMarket free download mobile retail applications for Android and iOS (iPhone), (the "App"), and (iii) BlueMarket's related online and mobile services as described in the Terms of Use (the "Services").

1.2 By clicking "I Agree" when you register with us and/or by browsing and using our Site, App and Services, you expressly consent to this Privacy and Cookie Policy governing:

1.2.1 your use of our Site, App and Services;
1.2.2 the use and disclosure of your personal data in the manner set out below; and
1.2.3 the use of cookies on our Site in the manner set out below.
If you do not accept such use and disclosure, you must not click "I Agree" or use our Site, App or Services. You may also refuse the use of some or all cookies as set out in section 3 below.

2. Data We May Collect From You

2.1 Personal data are information that identifies you as an individual (such as your name, address, telephone number, e-mail address, photo and credit or debit card details), and information about you or your activities or preferences when such information is directly linked to personal data.

2.2 We may collect and process the following data about you:

2.2.1 Personal data that you provide to us at the time of downloading an App or subscribing to any of the Services, including filling in forms on our Site, posting material or requesting further services.
2.2.2 Personal data that you provide to us when you report a problem or ask a question in respect of our Site, App or Services. If you contact us, we may keep a record of that correspondence.
2.2.3 We may also ask you to complete surveys that we use for research and marketing purposes, although you do not have to respond to them.
2.2.4 Details of your visits to and use of the Site, App and any Services, including, but not limited to the following:
(a) Device information: We may collect information about the device or any computer you may use to download the App onto your device, including the device's or computer's unique device identifiers, operating system, browser type and mobile network information as well as the device's telephone number.
(b) Location information: When you use one of our location-enabled Apps or Services, we may collect and process data about your actual location.
(c) Log information: We may automatically collect and store certain information about your use of the Site, App and Services in server logs, including but not limited to internet protocol addresses, internet service provider, clickstream data, browser type and language, viewed and exited pages and date or time stamps.
(d) Unique application numbers: When you install or uninstall an App containing a unique application number or when such an App searches for automatic updates, that number and information about your installation, for example the type of operating system, may be sent to us.
3. Cookies On Our Site

3.1 Our Site uses cookies to distinguish you from other users of our Site. This helps us to provide you with a good experience when you browse our Site and also allows us to improve our Site. Our App and Services do not use cookies.

3.2 Cookies are small files of letters and numbers that, if you agree, we store on your browser or the hard drive of your computer to enable our computer systems to recognize your browser and to tell our systems how and when pages within our Site are visited and by how many people. 4. Where We Store Your Personal Data

4.1 The data that we collect from you may be transferred to, and stored at, a destination outside South Africa, including the United States and/or Canada. By submitting your personal data, and using the Site, App and Services, you agree to this usage, transfer, storing and/or processing. We will take all steps reasonably necessary to ensure that your data are treated securely and in accordance with this Privacy and Cookie Policy.

4.2 Where we have given you (or where you have chosen) a password which enables you to access certain parts of our Site or App, you are responsible for keeping this password confidential. Please do not share your password with anyone.

5. How Your Data Are Used

5.1 We may use your data for the following purposes:

5.1.1 To provide the App and Services to you;
5.1.2 To operate and improve our Site, App and Services;
5.1.3 To provide customer service, including to respond to your enquiries and fulfil any of your requests for information;
5.1.4 To send you important information regarding the App and Services, changes to our terms, conditions, and policies and/or other technical notices, updates, security alerts, and support and administrative messages;
5.1.5 Unless you direct otherwise, to provide you with in App promotions, upcoming events, and other news about products and services offered by us, our affiliates and our partners, including merchants from whom you purchase goods or services via an App, which we feel may interest you;
5.1.6 To personalise your experience on the App by presenting information tailored to you and to your geographic location;
5.1.7 For our business purposes, such as data analysis, audits, developing new products, improving our Site, App and/or Services, identifying usage trends and determining the effectiveness of our communications;
5.1.8 To carry out our obligations arising from any contracts entered into between you and us;
5.1.9 To support any of the intended purposes specifically stated at the time at which you provided your personal data; and
5.1.10 For payment verification and fraud prevention purposes; and

6. To Whom Your Data Are Disclosed

6.1 In addition to disclosing your personal data as described in section 5 above, we may disclose your personal data:

6.1.1 To agents, service providers and third parties: We may disclose your personal data to any of our agents, service providers and third parties that provide services to us in order to allow or enable us to provide and manage the Site, App or Services.
6.1.2 To merchants: We may disclose your personal data to merchants from whom you purchase goods or services via an App.
6.1.3 To legal, regulatory or governmental authorities: We may disclose your account and other personal data when we believe that release is appropriate to comply with any legal or regulatory obligation or request, to protect our rights, privacy, property or safety, and/or that of our affiliates, you or others, or to enforce or apply this Privacy and Cookie Policy or our Terms of Use. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
6.1.4 In connection with corporate dealings: We may disclose your personal data in connection with any merger, sale of our or our affiliates' assets, or a financing or acquisition of all or a portion of our business or our affiliates' businesses to another company.
6.1.5 With your consent: We may disclose your personal data when you agree to our sharing such data with other third parties for their own marketing purposes and subject to their separate privacy policies.
6.2 We may also disclose aggregate information about you and other users with advertisers, publishers, business partners, sponsors, and other third parties.
7. Your Choice - Direct Marketing

7.1 You have the right to ask us not to process your personal data for marketing or promotional purposes.

7.2 You can exercise your right to prevent such processing by checking certain boxes on the forms we use to collect your data, or you will be provided with an opportunity to unsubscribe from any marketing or promotional information that we may send you each time this is provided to you. You can also exercise this right at any time by:

8. Your Rights in Relation to Your Personal Data

8.1 You can find out if we hold any personal data about you by sending a message to [email protected]. If we do hold personal data about you we will:

8.1.1 give you a description of it;
8.1.2 tell you why we are holding it;
8.1.3 tell you who it could be disclosed to; and
8.1.4 let you have a copy of the data in an intelligible form.
8.2 If we do hold personal data about you, you can ask us to correct, update, delete or otherwise limit our use of it, by email to [email protected]. We will comply with your request in accordance with and subject to applicable law.

8.3 Any request under this section 8 may be subject to reasonable administration fees (charged to you by us in accordance with applicable law).

9. Security

9.1 We have implemented suitable security policies, organisational, administrative and technical measures to protect and safeguard all personal data under our control from unauthorized access, improper use or disclosure, unauthorized modification, unlawful destruction or accidental loss. All our employees and data processors that have access to, and are associated with the processing of your personal data, are obliged to respect your privacy.

9.2 Please note that email or other communications via the internet are not always secure. Although we will do our best to protect your personal data, we cannot guarantee the security of the data that you transfer to use via our Site, App or via email; any transmission is at your own risk.

10. Retention

10.1 Your personal data will not be stored for any longer period than is necessary for the purposes for which they were collected, unless a longer retention period is required or allowed by applicable law.

11. Facial Recognition

11.1 Each time you make a payment via the App, we may use facial recognition technology for payment verification and fraud prevention purposes.

12. Sensitive Data

12.1 We ask that, with the exception of your photos, you do not send or otherwise disclose to us any sensitive personal data (e.g. information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background or trade union membership) on or through the Site, App, Services or otherwise.

13. Third Party Sites/App/Services

13.1 We are not responsible for the privacy, information or other practices of any third parties, any unaffiliated payment service or any other third party operated website or app to which the Site, App or Services contain a link.

14. Changes

14.1 We may change this Privacy and Cookie Policy at any time, at our sole discretion. Use of data we collect are subject to the Privacy and Cookie Policy in effect at the time such data is used. If we make changes to the Privacy and Cookie Policy, we will notify you by posting an announcement on the Site so you are always aware of what information we collect, how we use it, and under what circumstances if any, it is disclosed. If we make any changes to this Privacy and Cookie Policy, we will change the "Last Updated" date above. Changes in this manner shall be deemed to have been accepted if you continue to use the Site, App and/or Services after a period of two weeks from the date of posting on our Site.
